Criminal Cartel Offence Revision
On 1st April the law concerning the criminal cartel offence was modified. Section 47 of ERRA was implemented which makes a number of important changes to section 188 of the Enterprise Act 2002 (EA). This was the original legislation which created this offence. The purpose of this article is to consider this reform and to survey what changes it is likely to precipitate in relation to the investigation and prosecution of the cartel offence.
