Partner David Corker has been quoted in Law360 in an article that reports on legal experts warning that the watchdog’s focus on generating cash has come at the expense of securing convictions.
“Although DPAs have been a pragmatic measure that has extended the reach of criminal law, that benefit must be offset against the harm it has done the SFO in its prosecutions of related individuals… DPAs have been a seductive but sometimes poisonous event for the SFO. It has been enchanted by promises of corporate cooperation that have caused it to severely underestimate the difficulties in prosecuting individuals and overestimate the strength of its prosecution cases. This has led to calamitous outcomes for the SFO,” he said.
