Partner Maia Cohen-Lask, has been quoted in the press after the Supreme Court decision in R v Hayes and R v Palombo.
The Supreme Court quashed the traders’ respective criminal convictions for rate-rigging, concluding that the judge misdirected the jury in Hayes’ case.
The result is a “personal triumph” for Tom Hayes and Carlo Palombo, Maia says. The judgment does not go so far as to exonerate them, she notes, with the court concluding that there was “ample evidence” for a jury to convict them.
In Maia’s view, it is unlikely that a wider independent inquiry into rate-rigging, the banks and the Treasury will eventuate. There is now scope for future appeals of historic convictions, Maia suggests, depending on whether the directions in those cases fell into the same errors identified by the Supreme Court.
