Partner Nick Barnard has been quoted in Law360 UK on the UK government’s draft legislation establishing a new crypto-assets regime.
According to Nick, the Financial Conduct Authority will continue to face “significant challenges” in enforcing breaches because there is little that the agency can do to either impose penalties or prevent further unauthorised activity, where the entity concerned is outside the UK.
The regulator is also expected to “lean” on UK businesses that enable the trading of crypto-assets, such as banks that process payments, or search engines that allow them to market to British consumers, Nick adds.
