Securing evidence from overseas: competition investigations and new law for the digital age

Peter Binning and Edward Hodgson discuss recent legal proceedings limiting the extraterritorial application of criminal powers involving corporate entities.

The article examines the ability of law enforcement agencies, namely, the Competition and Marketing Authority (CMA), the Serious Fraud Office (SFO) and the Financial Conduct Authorities (FCA) to operate outside of their jurisdiction. It also examines the legislative efforts the government have put in place to address the extraterritorial limitations through the Digital Markets Bill (DMB).
