Senior Partner Jessica Parker comments in Law360 UK and Commercial Dispute Resolution (CDR) on President Trump’s recent decision to pause prosecutions under the Foreign Corrupt Practices Act (FCPA). The move is expected to have a knock-on effect on the Serious Fraud Office (UK)’s enforcement work.
The US has developed a reputation as “the world’s police officer”, with the U.S. Department of Justice routinely using trade in dollars or emails routed through US servers as a hook to fish for cases where the perpetrator, conduct and victim are outside the US, Jessica says.
New Attorney General Pam Bondi could use the selective enforcement of FCPA – using the aforementioned hooks – against foreign businesses to drive competitiveness for US business, Jessica suggests. This would be “very concerning” to the international business community, she says.
